Vital Verdicts Premises Liability — Building owner settles with man injured by falling ice. The owner of a Manhattan office building agreed to pay $130,000 to settle a suit filed by a tenant who was injured when a chunk of ice crashed through his office's window. The trial addressed the issue of whether ENT Realty Corp. was negligent in its maintenance of the building's rooftop drainage system. The plaintiff, Tsfasman, alleged that the drain's malfunction allowed water to collect and freeze on the roof. He contended that some of the ice fell off of the roof, into his office and onto his back, inflicting fractures of one shoulder and several ribs. ENT Realty argued that the ice did not fall from the building's roof, but it ultimately agreed to settle the case. Tsfasman v.
