Jed Kirsch recently tried a case to a successful conclusion
in Queens County. This was the second trial of the motor vehicle accident case,
which had resulted in a hung jury at the first trial. Our client's car was
struck by the driver of an SUV as he was turning into a driveway. Mr. Kirsch was able to successfully
incorporate video of the accident which had been obtained from a neighbor's
surveillance camera with the testimony of both drivers.
The trial was only on the issue of liability, as the parties
had agreed on the value of plaintiff's injuries and damages prior to the trial.
As a result of the verdict, we were able
to obtain a recovery of $53,000 for our client where the defendant's insurance
carrier had refused to make any settlement offer prior to trial. Our client sustained neck and back injuries
as well as an injury to the medial meniscus of his left knee, which required
surgery to repair.
