Jed Kirsch recently obtained a
settlement on behalf of a 65 year old woman who sustained a fractured left
wrist after she tripped on the broken top step of a Manhattan subway station on
her way home. We were able to obtain
photographs showing the defective and dangerous condition that existed at the
time of her fall, as well as photographs taken after the New York City Transit
Authority repaired the step. Deposition testimony taken of the Transit
Authority witness confirmed that the missing portion of the step constituted a
defective, unsafe condition.
Our client underwent surgery to
repair the fracture which included insertion of a plate and screws. Although
she has made a good recovery, we were able to obtain an excellent settlement of
$200,000, achieved through intensive, direct negotiations with the New York City Transit
Authority, with the assistance of the Court.
