Ronald Ingber and Jed Kirsch recently obtained a settlement for
the family of an Indian physician killed while on a bus trip to upstate New
York. The physician, part of a large
tour group, was on her way to Niagara Falls when one of the tires on the tour
bus failed, causing the bus driver to lose control of the bus, causing the bus
to careen off the road, leaving the shoulder and rolling over into a
ditch. She died at the scene. Information obtained from the "black
box" of the bus showed that the bus was driving over the posted speed
limit at the time of the crash.
Although there were significant questions concerning the
length of time the physician was alive following the crash as well as other
evidentiary questions, an excellent settlement of $350,000 was obtained through
extensive negotiations, both privately and with the assistance of the
Court. The settlement was at the top end
of settlements for this particular type of case.
